Photo Contest Terms

Eligibility

Northern Development Initiative Trust’s (“Northern Development”) Photo Contest is open to Canadian residents who have reached the age of majority in their province of residence by the date that they enter the Photo Contest. Entrants may be required to provide evidence of their identity and eligibility (i.e. address and date of birth). Failure to provide such proof within a reasonable period of time could result in disqualification.

All photos must be an original and may be in either colour or black and white. The photo must be of an image taken of a Northern Success Story published on the Northern Development website located at www.northerndevelopment.bc.ca.

Photos must be for personal and private use and not copied or reproduced from a third party source.
Both amateur and professional photographers are invited to participate.

Photo Subject Restrictions

Photos must be appropriate for posting on a public sector website, annual report, brochure or other public sector publication. Obscene, provocative or otherwise questionable content will not be considered. Northern Development retains the sole discretion as to what constitutes inappropriate content.

Photo Formats

Entries must be digital images and may be either black and white or colour. Images should be no smaller than 1800 by 1200 pixels (photos up-sampled are not eligible) and no larger than 10MB. Images may be submitted in jpg, png, raw or tiff format. Images must in natural colour or black and white. Sepia tone and duotone images are not eligible. Digital images should match the quality and character of the original digital capture.

Image Modifications

Minor digital enhancement is permitted, but images that have been significantly modified or appear unnatural will be disqualified.

Note: No print or film submissions will be accepted for entry into this Photo Contest

Return of Photos

Photos become the property of the Northern Development and will not be returned. Please do not send your only digital copy of a photo.

How to Enter

All entries must be submitted via the Photo Contest webpage with all form fields completed. If you are submitting multiple entries, complete a separate Photo Contest form and upload each photo submission separately.

Entry Deadline

Northern Development will announce at least one Photo Contest entry winner each calendar year. This contest is accepting entries at any time until such time as Northern Development modifies, or may no longer offer, the Photo Contest.

Number of Entries

Entrants may submit any desired number of entries.

Releases

If the photo contains any material or elements that are not owned by the entrant and/or which are subject to the rights of third parties, and/or if any persons appear in the photo, the entrant is responsible for obtaining, prior to submission of the photo, any and all releases and consents necessary to permit the exhibition and use of the photo in the manner set forth in these Photo Contest Guidelines without additional compensation.

If any person appearing in any photo is under the age of majority in their province of residence, the signature of a parent or legal guardian is required.

Entrants submitting photos containing a child under the age of majority in their province of residence are responsible for obtaining a signed Minor Release Form from the parent or legal guardian of the child appearing in the photo authorizing Northern Development and its licensees to use, reproduce, distribute and display the photos. An acceptable Minor Release Form must be emailed to Northern Development (social@northerndevelopment.bc.ca) by entrants where this necessary.

Photographer/Copyright

Entries must be submitted by the original photographer. Do not submit a photo taken by someone other than you. You must be the sole owner of the copyright of any image submitted.

Ownership/Use Rights

hotographers retain the copyright to their photos. By submitting photos to this Photo Contest, photographers (i) agree that they have read and understood these Photo Contest Guidelines and (ii) consent to and grant the irrevocable perpetual unrestricted, non-exclusive, royalty free rights and license to the use of all submitted photos to Northern Development for use on Northern Development’s website, annual report, brochures, newsletters or other Northern Development promotional material without any fee or other form of compensation and the right to use the photographer’s name as a credit along with the photo.

Judges

The Winners will be selected by a panel of judges. Judges will represent communities from each of the four Northern Development regions (Cariboo-Chilcotin/Lillooet, Northeast, Northwest, and Prince George regions) including Northern Development staff, directors, or advisors.

Judging Criteria

Entries will be judged on the basis of creativity, photographic quality and effectiveness in conveying a positive economic benefit made possible by a Northern Success Story.
Special emphasis will be placed on selecting a winning photo that showcases community members enjoying an event or facility that’s been supported by a Northern Success Story, people working who are employed as a result of a Northern Success Story, or the construction phase of a project undertaken as part of a Northern Success Story.

Entries that fail to comply with the Photo Contest Guidelines will be disqualified. The decisions of the judges are final.

Winners

Judges will select a Winner at least once every calendar year. If fewer than four (4) eligible photos are entered in a given calendar year, Northern Development may not choose a winner. Winners will be notified approximately 2 – 3 weeks after the Judges have arrived at a selection by phone and email using the information provided in the Photo Contest webpage form.
Winning photos, along with the photographer’s name, email address (optional) and information about the photo will be displayed on Northern Development’s website. No financial compensation is provided to winners.

Grand Prize

There is one available grand prize to be won in the Photo Contest each calendar year. In the current year, the grand prize is a 16GB Apple iPad. All prizes must be accepted as awarded. Prizes are non-transferable and cannot be exchanged or redeemed for cash or other prizes.

Indemnification by Entrant

It is the entrant’s responsibility to ensure that the publication of photos do not raise any legal claims. The entrant agrees to indemnify, release and hold harmless Northern Development and its employees, officers, affiliates, and agents from any and all damages, injuries, claims, causes of actions, or losses of any kind resulting from the participation in this Photo Contest, including infringement of intellectual property rights.

Limitation of Liability

Under no circumstances will Northern Development be liable to any person or business entity for any direct, indirect, special, incidental, consequential, or other damages based on any use of the website or any other website to which this website is linked, including, without limitation, any lost profits, business interruptions, or loss of programs or information, even if Northern Development has been specifically advised of the possibility of damages.

Northern Development assumes no responsibility for failure of the Internet or the website during the contest period, for any problems or technical malfunction of any telephone network or lines, computer online system, servers, access providers, computer equipment, software or any email, online or Internet entries lost due to technical problems or traffic congestion on the Internet or at any website or any combination thereof, including any injury or damage to an entrant’s or any other person’s computer or property related to or resulting from reviewing or downloading of any material in this Photo Contest.

Furthermore, Northern Development is not responsible for (i) lost, misdirected, misplaced, illegible, unintelligible, incomplete or late entries or (ii) any act, failure to act, or delay regarding the transmitting or processing of entries.

Right to Cancel or Suspend Photo Contest

Northern Development reserves the right, in its sole discretion, to cancel or suspend all or any portion of this Photo Contest without notice if factors beyond Northern Development’s control, including technical difficulties that disrupt or corrupt the fair or secure administration or operation of the Photo Contest.

Any attempt to deliberately damage the website or to undermine the legitimate operation of this Photo Contest is a violation of criminal and civil laws. If such an attempt is made, Northern Development reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

Northern Development is entitled to interpret these rules as needed and its decisions are final. Northern Development reserves the right to disqualify any entrant that Northern Development has reason to believe is not the original work of entrant, or does not otherwise meet the Photo Contest Guidelines. If a winner is disqualified or determined to be ineligible, an alternate winner will be selected using the same judging criteria described herein. Alternate winners are subject to all requirements set forth in these Photo Contest Guidelines.

Laws and Regulations

t is the responsibility of the entrant to adhere to all federal, provincial and municipal laws and regulations that may apply to this Photo Contest. These Photo Contest Guidelines are subject to change without notice in order to comply with any applicable federal, provincial or municipal law.

Use of Personal Information

By entering this Photo Contest, an entrant agrees Northern Development’s Privacy Policy for the collection, use, and disclosure of information, and Terms of Use for photography submissions.
Further, all entrants agree to allow Northern Development the use of all submitted photos for use on Northern Development website, annual report, brochures, newsletter or other Northern Development promotional materials without any fee or other form of compensation and the right to use the photographer’s name as a credit along with the photo.
